12-Year-Old Boy Struck by Pickup Truck in Chula Vista

Nicholas Mafnas, 12, was hit and seriously injured by a motorist in Chula Vista on January 18 around 7:15 a.m. near Oleander Drive. According to the Chula Vista police, the victim was struck by a pickup truck making a left turn on Telegraph Canyon Road.

The injured victim’s cousin saw him lying on the floor with his entire mouth from nose to chin covered in blood. Mafnas suffered broken teeth and a broken wrist in this serious pedestrian accident and was rushed to Rady Children’s Hospital for medical treatment right away. Our law office sends our best wishes for a speedy and complete recovery for the injured young boy.

The pickup driver told the Chula Vista Police that he did not see the boy.

Due to limited information on the circumstances leading up to the child injury accident, we can speculate that possibly distraction or negligence could have contributed to this serious pedestrian accident. Since the police saw that the driver was insured, licensed, and did not appear to have made any illegal moves, they let the driver go without any citation.

Pedestrians injured as a result of negligent motorists have lawful rights that deserve and need to be protected. While the investigation is in progress, the injured victim’s parents should seek legal guidance against the possible at-fault motorist to receive compensation for damages committed.

According to the Insurance Institute for Highway Safety (IIHS), approximately 180,000 people died in pedestrian accidents between 1975 and 2005.

Being a licensed and insured motorist does not prove that a driver was innocent. Fortunately, there were eye witnesses to this pedestrian accident, which will help the injured victim’s parents fight for justice.

Teen Paralyzed in Accident With Pickup Truck Settles Claim - Dallas, Texas

The Gustine Unified School District agreed to pay $17.5 million to a high school cheerleader who sustained a traumatic brain injury when she fell off the back of a pickup truck on her way to a parade. In 2008, coach Amy Sanchez told Natalia Lacayo, 17, and her teammates to sit in the back of the truck to go to the Gustine Fourth of July Parade. The truck's uninsured driver, Teodoro Cardoso, 17, allegedly accelerated too quickly, causing Natalia and four others to fall out. Natalia suffered head and brain injuries, which caused paraplegia and cognitive defects, and she now requires 24-hour care. Natalia's counsel blamed the school district, alleging it was responsible for Sanchez's negligent supervision and Teodoro's negligence as a volunteer for the school district. The district argued it wasn't liable for Teodoro, and Natalia was comparatively negligent because cheerleaders saw her stand up before she fell. The settlement was reached in mediation.
