Pace Van Causes Crash in Roseland

Tuesday, March 11, 2014
0 comments

Local police say that a Pace van attempted to make a left turn in Roseland last Monday when it was not safe to do so. As a result, the Pace van entered the path of a Cadillac and caused a collision, injuring eleven people. The collision occurred in the area of 111th and Wentworth in Chicago in the morning hours.

The Pace van was transporting as many as nine developmentally disabled adults at the time of the crash and the Pace driver was reportedly cited for failing to yield the right-of-way while turning left. The passengers of the Pace van were transported to area hospitals for examination where their conditions are not known, though it is believed that none were seriously injured.

The Cadillac was driven by a 55-year-old who was injured in the accident, as was a child passenger in the Cadillac. Both were taken to the hospital and were listed in stable condition.

The intersection where this accident occurred is small and controlled by a traffic light. It is not yet clear exactly how the crash occurred and whether the cars were on the same road at the time of impact. What is clear is that the actions of the Pace van driver placed the lives of her passengers as well as the lives of those in the other vehicle in danger. Through her negligence, eleven people were injured and had to be taken to the hospital.

People often think that they are safer while traveling by public transit than when they are in private vehicles. This sense of safety can be errant as crashes happen frequently between buses and vans used by the public. When these accidents occur, they are likely to result in injuries because often safety devices, including seat belts, are not present or are not used.

The fact remains that when you board a bus or a van driven by another, you place your safety in that driver's hands. Any mistake the driver makes can result in a collision that may lead to injuries or even death. This is the reason that there are strict laws governing the conduct of public transit drivers, including those who drive Pace buses, and that the insurance for these entities can be particularly difficult and confusing.

With most Pace bus accidents, there is insurance coverage available to pay for injuries sustained through the negligence of a Pace employee. Therefore those passengers within the Pace bus as well as the driver and passenger in the Cadillac may have a claim against Pace for their damages sustained in this collision.

Similarly, if you have been injured in an accident with a Pace bus, call the Chicago bus accident attorneys at Abels & Annes, P.C. today to learn if you have a claim. Driver Causes Collision While Speeding Away From Separate Crash

Home > Car Accident > Driver Causes Collision While Speeding Away From Separate Crash

A man on his cell phone rear-ended a vehicle and fled the scene when police approached him late Sunday morning in Chicago. As he fled, he caused a second collision just two blocks away, seriously injuring himself and up to five others in the Park Manor neighborhood.

A police officer who was filling his gas tank near Indiana Avenue and Marquette Road and saw a car driven by a man rear-end another vehicle. It is believed the driver was on his cell phone at the time of the impact. Both cars pulled over after the impact and the officer responded, initially talking to the car that was struck. When the officer began to walk to the at-fault vehicle that caused the rear-end crash, the driver took off from the scene. He tried to drive west on 71st Street over the Dan Ryan Expressway but he hit a minivan that was trying to turn left onto State Street.

The first crash resulted in damage only to the front vehicle which had a man and woman inside at the time of impact. They witnessed the second crash and said that an individual from the minivan was ejected as a result of the collision.

Police have said that the at-fault driver was in serious-to-critical condition after the accident and that four people inside the van were also hurt. Three people were taken from the scene to Advocate Christ Medical Center in serious-to-critical condition and three others were taken to Saint Bernard Hospital and Healthcare Center where their conditions were not immediately known.

The Chicago Police Department has not yet stated whether the driver who caused both collisions will face any civil or criminal charges.

Assuming this early information is all correct, the at-fault driver in these accidents committed several negligent acts. Initially he drove while on his cell phone. Cell phones are a significant distraction to drivers and are responsible for many crashes. In addition, using a cell phone without a hands-free device is a violation of local laws in many areas, though it is unclear how this driver was using his phone at the time of the first crash. In addition to driving while distracted, this driver fled the scene of a collision without speaking to police or providing identification information. What was only a minor collision with a small amount of property damage instead became a crime when the driver fled the scene and seriously injured several others. Finally it appears that the driver failed to yield the right-of-way to the minivan and thus caused the second collision. Though not all the details are yet known, collisions that eject one or more passengers often have a significant force, meaning that the car or the van or both could have been traveling at a fast speed.

If you have been injured by a driver who was negligent, including a driver on his cell phone, a hit-and-run driver, or even a driver who fails to yield to you, there may be a claim available for your injuries. Call the Chicago car accident lawyers at Abels & Annes, P.C. today for a free telephone consultation and to learn if you have a case. We have a lawyer standing by 24 hours a day so please call us now at (312) 924-7575.

Wrong Way Driver on Chicago Skyway Causes Crash that Injures 4

Home > Car Accident > Wrong Way Driver on Chicago Skyway Causes Crash that Injures 4

A serious collision occurred when a northbound Honda drove in the southbound lanes last week on the Chicago Skyway, according to police. The Honda struck a southbound pickup truck near 84th Street and caused a violent impact that pushed the pickup truck into a concrete barrier.

The driver of the pickup truck was injured and was treated at South Shore Hospital and later discharged. In addition to the driver, two passengers were in the Honda and all were injured and treated at various hospitals with the driver reportedly suffering a broken arm. A female passenger has been described as "gravely injured" and it is not clear whether she will survive.

It is not yet clear what caused the Honda driver to travel in the wrong direction but police say the driver will be issued citations.

Though it is not clear if alcohol was involved, alcohol is a common factor in many of the wrong-way collisions that occur in the United States every year. A driver under the influence is less aware of other motorists, including the direction they are traveling, and statistically pay less attention to road signs, making it easier to drive against traffic without realizing it.

Wrong-way collisions are often very violent and severe because each vehicle is traveling in the opposite direction, making the force of the impact large. This type of collision is also likely to produce injuries to the drivers and passengers of both vehicles.

Wrong-way collisions can often occur when a driver is inattentive or just not paying attention. Distraction may come from inside the car or out and can include things like phone conversations, texting, other passengers, children, arguments, the radio, checking email, and even a GPS system. When a driver is distracted, the driver is a danger to those on the road and is more likely to cause an accident than if he was focused and attentive on the road.

Whether they are caused by alcohol, distraction, or something else, wrong-way collisions are dangerous and often deadly, and the person injured or killed is often not the distracted driver. In addition to serious criminal charges, a distracted driver may also face civil claims for the injuries caused in a collision. Both people in another vehicle and passengers in the distracted driver's vehicle may be able to bring a claim if they are injured in a wrong-way crash.

If you have been injured as the result of a wrong-way collision, please contact the attorneys at Abels & Annes, P.C. for a free, no-obligation consultation. Driver Distracted By Cell Phone Charging Cord Causes Fatal Accident

Wednesday, September 25, 2013
0 comments

Authorities believe that a driver was distracted by a cell phone charger cord that was tangled around his steering wheel when he caused an accident on August 8, 2013.

The accident occurred in the 13900 block of South Cicero Avenue earlier this month. The at-fault driver reportedly was driving a Ford Taurus when he became distracted by his cell phone charger around 4:45 p.m. The Taurus turned into the rear passenger door of an SUV and caused a crash, leaving the family within the SUV injured. The occupants included a husband, wife, and their son. Both the husband and son survived with minor injuries and received treatment at Palos Community Hospital. The wife was initially transported to MetroSouth Medical Center in Blue Island but later was transferred to John H. Stroger Hospital of Cook County for further treatment. According to her family, she survived for several days before succumbing to her injuries. Her family also indicated that the woman had a history of heart problems before the accident that may have been aggravated by the crash.

Police investigating the accident cited the driver of the Taurus for failing to reduce his speed to avoid an accident, improper lane usage, and driving without insurance on his car. It is unclear whether the driver will face any additional charges stemming from the death of the woman in the other vehicle.

When driving, distractions can arise in hundreds of different forms. Commonly, drivers may be distracted by eating, the radio, conversations within the car, or a cell phone or even by things outside of a vehicle like an accident or a flashy billboard. Though it may be human nature to be curious about some things and to divert your attention from the road, it is each driver's job to stay focused on driving and to put the safety of other motorists first. When a driver allows distractions to divert his or her attention, accidents are much more likely to occur.

Many drivers believe that they are driving in a safe manner and that they are not distracted by anything while behind the wheel. Others believe that modern advances in technology mean that their use of technology makes them a safe driver. Despite these common beliefs, studies continue to show that a large number of drivers are distracted at some point throughout their daily drives and that technology may not reduce distraction rates significantly. Instead, these same studies show that drivers who use hands-free technology to make phone calls or text are still dangerous and are only moderately safer than those who do not use hands-free devices. The conclusion of decades worth of data indicates that it is the conversation itself and not the method of delivery that distracts thousands of drivers every day.

When a distracted driver causes an accident that results in injuries, the law may provide for a victim to make a financial recovery. This money can be used to pay for medical bills or to compensate a victim for lost income while the victim was injured. In many cases, there is insurance available to cover an accident, but often the insurance available is not enough to fully cover all losses. Illinois has low levels of mandatory insurance and as a result, in the case of a catastrophic injury or death, a victim may need to explore other avenues of recovery to obtain full and adequate payment.

Elderly Driver Crashes Into Liquor Store, Causes Fire

Tuesday, September 24, 2013
0 comments

Police have reported that an 84-year-old woman was behind the wheel when her car crashed through a local liquor store on Thursday. The woman reportedly hopped a curb and crashed through the front entrance of Binny's Beverage Depot in Highland Park on Monday where her vehicle entered part of the store and came to rest between several stacks of liquor.

The woman states that she has never had an alcoholic drink in her life and that she believes her accelerator on her 1998 BMW may have stuck, causing her car to continue forward at Crossroads Shopping Center. The driver remained in her car until an employee of the liquor store helped her to safety. The crash also started a fire in the store that officials believe was fueled by the liquor itself.

Both the employee and the driver were taken to area hospitals where they were treated for minor injuries. Both are expected to fully recover and the driver has been released at this time. The current condition of the employee is not known. The store had a sprinkler system that helped keep the fire under control until fire fighters arrived. The blaze was extinguished shortly after fire officials arrived and eyewitnesses noted a large amount of smoke billowing from the building.

There has been no word on whether any customers were in the store at the time of the crash but several other employees were inside. None of them sustained any injuries but witnesses said that employees were covering their mouths as they exited the smoke-filled building. Police are still investigating the cause of the crash and it is not yet known if the driver will be cited for the accident.

Though the driver claimed that her accelerator stuck and caused the accident, that has not yet been confirmed and it is not clear whether the driver's advanced age contributed to the crash. When a driver is negligent and causes an accident, though, the driver may face traffic charges or a civil claim for any injuries that result. The law requires every driver to act with due care and caution while behind the wheel and when a driver fails to do so, the driver breaks the law.

In a case like this, when a driver causes damages to the property of another, the driver may be forced to pay for the damages done. More importantly and often more significantly, the driver may also be responsible for paying for personal injuries caused in an accident. Victims of car accidents can bring civil claims for their medical bills, pain and suffering, and lost wages.

After an accident, often a victim is in shock and believes that they only suffered bumps and bruises. Many times, though, the full extent of injuries will only become apparent as time passes and may include broken bones, injuries to the neck or back, or trauma to the head. Some injuries can only be detected after swelling decreases meaning that it is impossible to address or treat some injuries immediately after an accident.

If you have been involved in an accident with an automobile, regardless if you were in another car or as a pedestrian, you may have a claim for your injuries. Call the Chicago car accident lawyers at Abels & Annes, P.C. today and let us provide you with a free, no obligation telephone consultation regarding your rights and your options. Rainy Weather Causes Fatal Car Accident on Friars Road

Saturday, August 3, 2013

An unidentified motorist died in a fatal two-vehicle wreck that took place on January 6 around 8 a.m. on Friars Road. According to the San Diego Police, the motorist was exiting northbound Interstate 15 on road that was newly rained on when the vehicle spun out of control and hit a fuel delivery truck going east towards Friars Road.

The car driver died at the accident site. Our law office sends heartfelt condolences to the deceased victim’s family and friends for such a shocking loss.

Although authorities stated that wet road was the main reason why the car driver lost control of the car, other factors such as speed and/or distraction from either party may have also contributed to the accident as well. Further investigation is certainly required.

Rain can make driving on roads much more dangerous. Making a sudden stop or trying to avoid a collision with another vehicle can have negative repercussions on wet road compared to dry road. According to the California Highway Patrol (CHP), auto accidents tend to increase by more than 200% in rain and the main reason behind this is that motorists do not alter their normal day-to-day driving habits.

All drivers need to remember to drive slower and to change quick driving behavior during rainy weather and after the rain has stopped.

We advise the deceased victim’s family members to seek advice and counsel from an experienced San Diego car accident wrongful death lawyer who will determine their legal options.

Please remember to drive safely during winter months in San Diego, especially during or after poor weather. Let’s do our part in making our streets, wet or not, much safer.

3 Doors Down Bass Player Allegedly Causes Fatal DUI Crash

Wednesday, May 29, 2013
0 comments

The bassist for the band 3 Doors Down is being held in a Nashville jail after he reportedly caused a collision while speeding and driving impaired, according to the Chicago Tribune.

Police stated that the bassist, Robert Todd Harrell, showed obvious signs of impairment at the scene and that “he acknowledged consuming hard cider and taking prescription Lortab and Xanax” before the crash.

Authorities believe that Harrell was speeding in a suburb of Nashville, Tennessee on westbound Interstate 40 when he hit a pickup truck. The driver of the truck lost control and the truck struck a guardrail, left the road and then flipped at least once before coming to a rest. The driver was ejected and died as a result of the collision.

Harrell has been charged with vehicular homicide by intoxication and is being held on a $100,000 bond.

Following his arrest, Harrell was taken to a local jail where sheriff’s deputies found a plastic bag with 8 Xanax pills, 24 oxycodone pills, and 4 oxymorphone pills concealed in Harrell’s sock. Xanax is an anti-anxiety medication available by prescription while oxycodone and oxymorphone are prescription pain relievers. It is not clear whether Harrell had a prescription for any of the drugs in his possession.

The band issued a statement on its website saying they were saddened by the passing of the victim and that the band’s hearts and prayers go out to the victim’s family and friends.

Harrell was arrested last year and charged with driving under the influence after he was involved in a crash with another vehicle.

This recent crash puts a spotlight on the dangers associated with driving under the influence.
Every day nearly 30 people die in the United States in alcohol-related crashes, or nearly one every 48 minutes. Estimates put the cost of drunk driving in excess of $51 billion per year.

The people most at risk for impaired driving are young people, motorcyclists, and drivers with prior convictions for driving while impaired. The early reports suggest that the impaired driver in this crash had a history of alcohol-related driving. Statistically, drivers with a blood alcohol content of 0.08 percent or higher involved in fatal crashers were four times more likely to have a prior conviction for driving while impaired than were drivers with no alcohol in their systems.

This means that drivers who have been convicted of driving under the influence are more likely to do so again in the future than those who have never driven drunk. Drunk drivers are significant risks to all drivers and passengers on the roads because drunk drivers have slowed response times, delayed ability to process dangers, and are not as vigilant as sober drivers, increasing the risk of collision.

Driving drunk is illegal in every state in the nation and with good reason. Avoid being a drunk driving statistic by following these simple tips: never drive drunk, never ride in a car with someone who has been drinking, always designate a sober driver before drinking or take a taxi for transportation, and if a friend has been drinking, take away his keys so that he will be unable to drive under the influence.

Even though drinking and driving is illegal, people still do it every day in Chicago. If you or a family member has been injured by a negligent driver under the influence of alcohol or drugs, call the drunk driving accident attorneys at Abels & Annes, P.C. today for a free consultation regarding your injuries. We have worked on numerous drunk driving cases over the years and we are ready to start working on your case today. Call us at (855) LAW-CHICAGO.

Distracted DUI driver causes fatal Chicago crash on Memorial Day

Tuesday, June 7, 2011
0 comments

A female motorist that was allegedly driving under the influence of alcohol on Monday lost control of her car and crashed, resulting in the death of a baby and injuring three other kids, according to the Chicago Tribune. She reportedly was picking up a chip when she lost control of her vehicle on the Dan Ryan Expressway.

The DUI driver, 47-year-old woman who resides in the 5200 block of S. Paulina Street, is now facing reckless homicide and aggravated driving under the influence charges, both felonies. A judge set her bail at $350,000, according to a spokeswoman from the state's attorney's office. Prosecutors allege the defendants blood-alcohol level was .164, over twice the legal limit in Illinois.

The at fault driver had seven passengers in the 1993 Oldsmobile Cutlass that she was driving. The accident took place around 6:30 PM on Memorial Day. The incident closed the expressway for around two hours, causing a significant holiday traffic on Monday night. The vehicle is only built to accommodate five occupants, so none of the children were in seatbelts or car seats at the time of the crash.

She stuck a guard rail in the area of 75th St., causing the vehicle to spin multiple times and roll over. The Chicago Sun-Times is reporting that children were ejected from the vehicle.

Investigating Illinois state troopers stated the driver smelled of alcohol and had bloodshot, glassy eyes. She also admitted that she drank a lot of beer at a barbecue, and there were several open cans of beer inside the vehicle. Witnesses also saw the car swerving.

An 11-month-old boy lost his life in the accident. He was just a week away from his first birthday.

Another passenger, an eight-year-old boy, is in critical condition with a lacerated liver. He was rushed by ambulance to University of Chicago’s Comer Children’s Hospital. Two other passengers, a three-year-old girl and a four-year-old girl, sustained skull fractures. A six-year-old boy was also seriously hurt, but the nature of his injuries were not stated. All of the injured children were taken to Comer.

Two adults were also critically injured in the crash. One was taken by ambulance to John H. Stroger Jr. Hospital of Cook County and the other was taken to Advocate Christ Medical Center in Oak Lawn.

The Tribune further reports that according to the Illinois Secretary of State's office, the DUI motorist at a good driving record and a valid license.

Is was not reported if an Illinois personal injury lawyer is involved in the case or if a negligence lawsuit is been filed.

While our hearts go out to the victims and their families in this accident, this is a good example of the dangers of distracted driving. It's not just texting and cell phones that can cause a driver to take their eyes off the road. It can also be something as simple as leaning over to pick up food or coffee, or even adjusting the car stereo.

Illinois motorists should be aware that losing that fraction of a second of reaction time can be the difference between life and death. It's better to wait until you are at a safer location.

Further, when you combine distracted driving with a motorist under the influence of alcohol, that is an especially dangerous combination.
