Actor Chris Brown Charged in Hit-And-Run Crash

Thursday, February 13, 2014
0 comments

Just when it seemed it had been a while since Chris Brown made the headlines, authorities announced that they have charged the famous singer after a hit-and-run crash that happened back in May. The crash reportedly happened in Los Angeles and has Brown facing charges of driving without a valid license and a misdemeanor charge of hit-and-run.

The accident occurred when Brown reportedly rear-ended another car near Toluca Lake. Reportedly Brown refused to give his driver's license information to the other driver and gave fake insurance information. He then left the scene of the crash.

Failing to provide accurate information is a misdemeanor that could land Brown with jail time. However, the celebrity has taken to Twitter to strongly deny all allegations. According to his official Twitter account, Brown states that he provided his driver's license information and that he had a valid license at the time of the crash. He also states that the insurance information he gave was correct. Brown has posted a picture of what he claims is the other car involved in the accident. According to him, the car shows no damage and there was no damage done to his car either. Brown alleges that the other driver noticed the cameras surrounding him and it caused her to contact "the cops thinking of a payday from Chris Brown when [he] followed proper procedures."

These charges are significant for Brown who is currently on probation for a 2009 felony after Brown pleaded guilty to assaulting girlfriend Rhianna. With these new charges, a judge could determine Brown is in violation of his parole and revoke it, sending him to jail or prison. Prosecutors have claimed that they will not seek to revoke Brown's probation due to this recent incident. Brown is also facing charges that he pushed a woman in a nightclub on Saturday night, causing her to fall and injure her knee. He also denies those claims.

When it comes to hit-and-run accidents, each state has slightly different laws but all states require a driver to remain on the scene after a crash and provide basic information. In Illinois, fleeing the scene of a crash that results in great bodily harm or death is a felony charge and can lead to years in prison if a driver is convicted. When a driver causes an accident that injures another and then leaves, the injured person may not receive the needed medical care, which increases the chance of permanent injuries occurring or even death.

Many hit-and-run drivers are identified after a collision takes place. When this happens, the consequences can be significant. Regardless of whether a fleeing driver is later identified, though, an injured victim may have a claim for injuries that are incurred as the result of a hit-and-run accident.

Man Charged in Fatal Tinley Park DUI and Hit-and-Run Crash

Wednesday, January 8, 2014
0 comments

The hit-and-run driver of a vehicle that killed a pedestrian on Wednesday night has been arrested and charged, according to Tinley Park police. The 22-year-old Blue Island resident has been charged with aggravated driving under the influence and failure to stop after an accident causing personal injury or death.

A 61-year-old man who was visiting Tinley Park from India was crossing 159th Street southbound at 80th Avenue at about 9:30 p.m. when he was hit and killed by a black pickup truck. The truck fled the scene but left evidence including his license plate behind, a key element that helped police make an arrest.

A witness described the victim as laying in the middle of the road, a shoe and a bag he was carrying several feet away from his body and said the impact sounded like a large boom. A relative described the victim as "a very fun loving person" who "liked to travel." Reportedly, he was a mayor and a social worker in India in his local municipality.

The charges against the driver in this case are significant and if convicted, could result in a long incarceration stint, depending on the driver's prior history and other extenuating or aggravating factors. Driving under the influence of drugs or alcohol places a defendant at an immediate risk for a suspended license and fines, if convicted, and the consequences can be more severe.

In America, someone is killed as the result of a drunk driver every 51 minutes. This adds up to over 10,000 deaths at the hands of drunk drivers every year. None of these deaths are necessary and all are preventable by simply not driving after drinking. There are numerous alternatives in Illinois including public transportation, taxis, designated drivers, or even walking. But getting behind the wheel while under the influence of alcohol is reckless and often results in injuries or death of innocent bystanders, as it did in this case.

Driving under the influence is a crime that this driver has been accused of, and leaving the scene of an accident is also a crime. Here, the driver allegedly failed to stop to render aid, failed to wait for the police to respond, did not provide any of his identification information, and did not remain at the scene after the crash. This is a felony offense in Illinois unless the driver needed to seek immediate medical attention, and there is no indication that the driver was hurt in this accident. This charge alone, separate from the DUI charge, may result in jail time if the driver is convicted.

These penalties are harsh because the behavior they are designed to address is so extreme and so hazardous and often deadly. If you have been involved in a collision caused by a driver under the influence or by a driver who fled the scene, you may have a claim for any injuries you sustained.

At Abels & Annes, P.C., we are Illinois hit-and-run injury lawyers who know how to deal with insurance companies and difficult defendants. We stand side-by-side with our clients and we fight for their rights. Bicyclist Injured by Hit-and-Run Motorist in San Marcos

Thursday, October 17, 2013
0 comments

A 47-year-old man was seriously injured in a hit-and-run accident that occurred on January 20 around 12:28 a.m. in San Marcos. According to the San Marcos Sheriff's Station, the victim was riding a bicycle in the bike lane when he was struck by an unknown vehicle travelling westbound.

The motorist crossed into the bike lane and rear-ended the bicyclist on East Mission Road. The impact of the collision caused the bicyclist to tip over the handle bars and strike his face on the curb. The injured bicyclist sustained major facial injuries and was taken to Palomar Medical Center for medical treatment immediately. We all send our best wishes for a speedy and complete recovery for the injured bicyclist.

Deputies said that the motorist failed to stop at the accident site and fled westbound. According to California Law, it is illegal for any motorist to leave the scene of an accident that they were involved in without giving personal information or providing aid to an injured party. Leaving the accident site carries penalties that can vary from prison time to large fines. The motorist in this case will possibly be charge with the felony hit-and-run.

Hit-and-run accidents are a serious offense in the state of California and account for nearly 10% of fatalities.

According to the National Highway Traffic Safety Administration (NHSTA), around 50,000 bicyclists suffered injuries and more than 600 died in bicycle accident crashes in the year 2009.

Bicyclists should have the assurance of riding safely on roads, especially in designated bike lanes. Unfortunately, negligent motorists will put bicyclists and pedestrians lives as risk when they violate the rights of others on the road. Any type of the impact with a vehicle can have severe consequences to a bicyclist. High speed collisions often result in a compound fracture, spinal cord injury, brain injury, and even death.

The injured bicyclist should immediately seek advice from an experienced San Marcos bicycle accident attorney to secure his future medical needs and finances.

If you have any information related to this accident, please contact the San Marcos Traffic Unit at (760) 510-5200.

Chicago Hit-And-Run Crash Leaves 1 Dead

Thursday, September 26, 2013
0 comments

Chicago police are searching for the driver of a silver truck that is believed to have been involved in a hit -and-run accident early Sunday morning.

The crash occurred in the 1600 block of North Kostner Avenue on the northwest side of the city and involved three vehicles, including the silver truck that has been described as a Toyota, possibly a Tacoma. Police believe that the driver of the Toyota truck collided with a Toyota Camry and a Hyundai Elantra, causing a significant crash that seriously damaged at least one of the vehicles.

A 25-year-old man was behind the wheel of the Camry and died at the scene of the crash. There was a 17-year-old male passenger in the Camry who was injured but is expected to survive after being transported and treated at Advocate Illinois Masonic Medical Center. Reportedly, there were two people in the Hyundai and neither appeared to sustain injuries.

The driver of the Toyota truck fled the scene after the crash without providing his information to the other drivers or the police. In Illinois, leaving the scene of an accident that causes death or serious bodily injury is a felony and police are searching for that driver at this time.

Hit-and-run drivers break the law when they leave the scene of a crash, but despite the risk of serious charges against them, many Illinois drivers continue to flee and leave behind victims of crashes, many who may be unable to seek medical help themselves. If a fleeing driver leaves an unconscious or seriously injured victim behind, the chances that medical help will arrive in a timely manner decrease, putting the victim at a much higher risk of death or permanent injury. It is also every driver's duty to act with care and caution towards others on the road and leaving an injured victim without assistance directly violates this principle, further threatening public safety.

With the addition of street side cameras and other recording devices, more of these hit-and-run accidents are being captured on film and more offenders are being apprehended. These drivers may be prosecuted for criminal violations, traffic offenses, or both, but that is not always the extent of their liability. In many cases, the victim of a hit-and-run crash may be able to bring a civil claim for their personal injuries against an at-fault driver so that compensation can be obtained. These civil cases generally seek monetary payments to cover expenses like medical bills, pain and suffering, and lost wages.

Even in a hit-and-run accident where the fleeing driver is never found, a victim may still have a valid claim for their damages. Here, a victim or a victim's family may be able to bring a claim against their own insurance company for their losses through a type of claim known as an uninsured motorist claim. This protects Illinois drivers in instances where an unknown or an uninsured driver causes an accident that results in injuries.

If you have been the victim of an automobile accident, whether or not the other driver is known, you may have a claim for your damages. The Chicago hit-and-run injury lawyers at Abels & Annes, P.C. offer all accident victims a free telephone consultation at (312) 924-7575 so that you can learn about your legal options for a recovery. We care about accident victims so we have a lawyer standing by 24 hours a day to take your call; we are here for you when you need help the most. Lincoln Square Hit-And-Run Leaves Pedestrian Dead

Tuesday, September 24, 2013
0 comments

Just before 5:00 a.m. on Saturday morning, police received a call about an unresponsive man in the road in Lincoln Square. Now, police believe the man was the victim of a hit-run-driver. The victim's injuries were so severe that he died at the scene.

The incident occurred in the 2100 block of West Wilson Avenue on the city's far north side. Police stated that no driver was present on the scene when they arrived to explain the incident and the man was unresponsive before he died. An autopsy on Sunday confirmed that victim died as a result of multiple injuries sustained in a collision with a car but at this time, it is not clear the type of car or who was driving at the time of the crash.

In Illinois, leaving the scene of an automobile accident that results in death or serious bodily injury is a felony charge, meaning that in addition to having a driver's license revoked and fines imposed, anyone found guilty of the offense can face serious time in prison. The laws are very harsh because when an uninjured person leaves the scene and leaves another behind who is too hurt to call for help, the authorities may not be alerted and that victim may die while awaiting needed medical care.

In addition to a charge for leaving the scene of an accident, a driver that causes a fatal crash might face traffic offenses brought by the State of Illinois. Often, these include failing to reduce speed to avoid a collision, failing to yield the right of way, and failing to exercise due care for others. Sometimes, multiple charges are treated as separate offenses for sentencing purposes meaning that a driver may face even greater time behind bars or an even greater financial fine.

If the threat of criminal and traffic prosecution weren't enough, offenders who leave the scene of an accident may also face civil claims for the injuries they inflict on others. These claims can include assertions for medical bills and treatment as well as time missed from work. Where a victim is killed, a claim can still be brought by the victim's surviving family members and can be made for the losses they suffer, which is massive.

With all that is placed at stake, it may be surprising that hit-and-run crashes are relatively common in both Chicago and Illinois. Some drivers flee after an accident because they do not have valid insurance or a driver's license. Others are under the influence of drugs or alcohol and get scared of the charges they will face. Still other drivers just get scared and take off because they are afraid of what they've done. Regardless of the reason, there is never a valid excuse to leave the scene of an accident and leave victims behind to suffer.

If you have been involved in a hit-and-run accident, you may have a claim for your damages. Many accident victims are unaware that they have a valid claim even if the at-fault driver is never found. When a driver is found, a claim can be brought against that driver personally or his insurance company for your loss and your suffering. When the at-fault driver is never found, you can still have a claim against your own insurance company. The majority of Illinois motorists carry a type of insurance that protects them in the case of a hit-and-run crash and that will provide financial compensation in the event of an accident that causes injury.

If you have been the victim of an automobile accident, call the Chicago hit-and-run lawyers at Abels & Annes, P.C. today and let us provide you with a free case consultation. We are standing by 24 hours a day to take your call at (312) 924-7575 or toll free at (855) 529-2442. At Abels & Annes, there is never a fee unless we make a recovery on your behalf. Fatal South Side Chicago Hit-And-Run Leads to Arrest

Monday, September 23, 2013
0 comments

A 27-year-old woman from West Pullman has been arrested and charged in a fatal hit-and-run crash that left a 77-year-old man dead. The woman appeared in court on Wednesday where the judge ordered that she be held on $250,000 bail.

The incident occurred on July 17, 2013 around 7:00 a.m. The prosecutor in the case alleges that the victim was crossing in the 8300 block of South Racine on foot when the defendant approached him in a black Mercedes, traveling northbound. The woman struck the victim with her car and fled the scene without stopping to check on the man's condition or without speaking to police.

There were witnesses to the collision who notified the authorities. When paramedics responded, the male victim was transported to Advocate Christ Medical Center but was pronounced dead shortly after his arrival. Meanwhile, local police interviewed several suspects who had a description of the responsible vehicle. The officers also obtained security footage from an area establishment that reportedly caught the collision on film, including the car striking the victim and then fleeing the scene. According to authorities, two eye witnesses have identified the defendant as the woman that was driving the Mercedes at the time of the crash.

With the information gathered from their investigation, police arrested the 27-year-old woman on Monday in her home. She reportedly works in medical billing, is a mother to an 11-year-old son, and is studying to be an x-ray technician.

It is not clear exactly what charges the woman is facing in connection with the crash, but under Illinois law, it is a felony to leave the scene of an accident that results in death or serious bodily injury to another. Therefore, this woman could be facing the possibility of extended jail time as well as becoming a convicted felon if the alleged facts against her are proved at trial.

If the potentially serious criminal and traffic offenses faced are not enough, this woman may also face a civil claim brought by the surviving family members of the victim on his behalf. This type of civil claim, often referred to as a wrongful death suit, may allow a victim's family to seek compensation for the loss of their loved one.

When the negligence of a driver takes a loved one away from his or her family, there is nothing that can fill the void left by that loved one's absence. The last thing family members should have to worry about is how they will pay the bills, including any medical expenses that the loved one incurred before death, while they are trying to move forward. That is one thing a civil claim can do for a family. A monetary settlement may make it possible to continue living life without the threat of financial ruin.

If your loved one has been injured or killed in an accident, call the Chicago hit and run injury lawyers at Abels & Annes, P.C. today and let us provide you with a no obligation telephone consultation. We only represent victims and their families and we are dedicated to each of our clients. Police Searching for Hit-and-Run Motorist in El Cajon

Thursday, September 19, 2013
0 comments

A truck driver was injured in a two-vehicle crash that took place on January 9, around 3 a.m. in El Cajon. According to California Highway Patrol (CHP) officers, a white colored Honda Civic and a truck plowed into each other on an Interstate 8 onramp, east of Mollison Ave.

The crash impact caused the truck to roll over on its side. The roof of the Honda Civic was slashed open and the windshield was crushed. The Honda Civic driver fled from the rollover accident site after the crash.

Emergency crew responded to the crash and immediately took the truck driver to a local hospital for immediate medical attention.

A search was conducted by emergency crews both on foot and by air to locate the Honda Civic driver. We sincerely hope that the Honda motorist is apprehended as soon as possible and brought to justice.

There are several reasons why a driver might choose to flee the accident site, including having no or suspended driver’s license, no insurance, distracted driving, and being under the influence of drugs or alcohol. A complete investigation in this case is needed to determine the at-fault party.

It was revealed by national government statistics that more than 11% of car accidents are hit-and-run crashes. According to the California Highway Patrol (CHP), around 15,600 hit-and-run collisions were reported in the year 2009. In these, around 15,400 people were injured and more than 100 died.

When someone is hit and seriously injured in a hit-and-run accident, the end result of such a situation can be extremely hard for anyone to handle. Professional help from an experienced hit-and-run accident attorney can help the injured truck driver pursue legal action against the at-fault motorist and receive compensation for damages done.

Due to the nature of hit-and-run accidents, it may seem trickier to recover damages from insurance companies. The injured victims should seek counsel from an experienced hit-and-run accident attorney who is well equipped to deal with these complex situations. If you have any information that can help San Diego police find the Honda motorist, please contact a local police station.

Hit-and-Run Motorist Admits Killing Elderly Widow in National City

Monday, September 2, 2013

Eighty-one-year-old Elana Huerta was fatally struck by a motorist in National City near East 19th Street on January 5 around 6:30 p.m. According to Police Sgt. Alex Hernandez, Alejandro Lomas Hernandez, believed to be in his 40s, turned himself in at the National City police station and admitted that he struck the female pedestrian and fled from the accident site.

The injured pedestrian was immediately transported to the UCSD Medical Center, where she was later pronounced dead. Our deepest condolences go the deceased victim’s family and friends.

Hernandez was arrested on the suspicion of felony hit-and-run driving.

When an auto accident occurs in San Diego, the persons involved in the fatal car crash are required to stay at the accident site to enable the law enforcement officers to carry out a thorough investigation. Unfortunately, not everyone abides by this law and some will flee from the site after getting involved in an accident.

Family members of the people killed in hit-and-run crashes often feel that they do not have any recourse to pursue compensation for the damages done. However, the deceased victim’s family needs to know that an experienced hit-and-run accident attorney can educate them about various potential avenues to obtain compensatory damages.

According to the National government statistics, around 11% of all car accidents fall in the category of hit-and-run crashes.

Many hit-and-run crashes remain unsolved as the police and investigating officers deem them unsolvable due to lack of evidence and/or eyewitnesses. Thankfully, there was an eyewitness in this case that described the suspect and the at-fault motorist came forward admitting to his crime.

It is a relief to know that at least one hit-and-run case will be solved soon and that more attention can be directed to solving other cases.

If someone you know has been harmed by a hit-and-run motorist, contact our experienced National City hit-and-run victim attorneys at (888) 233-5020.

One Injured in La Presa Hit-and-Run Crash

Friday, August 30, 2013

One person was injured in a hit-and-run crash that took place on November 27 around 2:20 a.m. in La Presa. According to the California Highway Patrol (CHP), a black-colored SUV crashed into two parked vehicles near Grand Avenue and St. George Street.

The male motorist left the wrecked vehicle at the scene and fled, leaving his passenger seriously injured in his car. Fortunately no one was present inside the two parked vehicles that were hit.

The female passenger was immediately rushed to a local hospital for medical assistance. Our law office hopes and prays for a quick and complete recovery of the injured passenger.

According to California Law, a driver that is involved in an accident is required to stay on the scene if property damage, injury of another person, or death of another person occurs. Leaving the scene is illegal and carries consequences including jail time and/or a large fine. Since the male motorist fled in this case, he will most likely be charged with the felony hit-and-run.

Victims injured in hit-and-run accidents need to realize that there are possibilities to receive compensation if they consult with a knowledgeable hit-and-run accident lawyer. Hiring an experienced hit-and-run accident lawyer to represent you will give you an advantage in dealing with the legal system and how best to deal with the at-fault motorist that fled from the scene.

Our experienced La Presa hit-and-run accident lawyers are committed to defend your rights and protect your future. Call us at (888) 233-5020 to discuss your case.

Pedestrian Struck by Hit-and-Run Motorist near El Cajon

Wednesday, August 21, 2013

A pedestrian was struck by a truck that did not stop on December 5 around 5:30 p.m. at Sumner Avenue. According to the California Highway Patrol, the pedestrian was hit by a vehicle described as a 1970’s or 1980’s Chevrolet truck in a gray or white color.

The injured pedestrian was immediately transported to Sharp Memorial Hospital for treatment. Our law office sends out our best wishes for a quick recovery for the injured victim.

Officers are still on the look-out for the motorist that fled from the accident scene. The last place the at-fault motorist was seen was going southbound on First Street going towards Broadway.

Hit-and-run accidents can lead to severe injuries and can have serious long-term health consequences. A great number of hit-and-run accident victims suffer from spinal cord injuries, brain damage, or have become paraplegic due to the impact of the crash.

Hit-and-run accidents are a serious crime in California, and account for almost 10% of fatalities. According to the U.S. National Highway Traffic Safety Administration (NHTSA), 49,128 pedestrian fatalities occurred from 1997 to 2006 as a result of hit-and-run accidents.

Pedestrians who are injured as a result of negligent drivers have valid legal rights that deserve to be protected. Due to the nature of a hit-and-run incident, it can be difficult to recover from the at-fault motorist if he or she cannot be found. Fortunately, there are ways for the injured victim to seek compensation under his or her own insurance coverage.

If the at-fault motorist is found and detained, the injured victim should file a personal injury claim to get their deserved compensation.

Our El Cajon hit-and-run accident attorneys are equipped to start investigating your case right away to help you fight against the insurance companies. Call the Jurewitz Law Group at (888) 233-5020 to learn about your legal rights in a hit-and-run accident case.

Chicago personal injury lawyer to represent man hurt in hit-and-run accident

Saturday, June 4, 2011
0 comments

Illinois car crash attorneys at Abels & Annes have agreed to represent a Chicago man that was injured in a traffic collision in May, 2011. The incident occurred at Clark and Jackson in the Loop.

The plaintiff was sitting at a red light when a pickup truck slammed into the rear his car. The pickup then fled the scene, driving away going westbound on Jackson Street, which is an eastbound one-way street.

After the accident, both our client and witnesses were able to take down the hit and run driver's license plate number. The Chicago Police Department responded to the scene of the collision and ran the license plate number, identifying the owner.

The next day the plaintiff called the defendant, who surprisingly cooperated, admitted involvement and gave his auto insurance information. It is unclear if he will now face criminal charges for fleeing the scene.

In my experience, a fact pattern like this is uncommon. Typically drivers that flee the accident are uninsured.

The plaintiff sustained neck and back, shoulder, and right elbow injuries in the crash. He was treated at Stroger Hospital after the crash.

In the days following the incident his pain only increased. He is now under the care of a medical doctor in the Chicago area.

The plaintiff's vehicle sustained heavy damage in the accident and was totaled.

If you have been hurt in an Illinois car accident, contact the personal injury lawyers at Abels & Annes for a free case evaluation. Call us at 312-924-7575.

Felony charges filed in deadly Illinois hit-and-run pedestrian accident

Tuesday, May 24, 2011

Chicago pedestrian accident lawyers previously reported that a 75-year-old man was struck and killed by a hit-and-run driver at the intersection of Kimball Avenue and North Avenue on April 1. Now comes word that a 38-year-old West Side resident has been charged with a felony count of leaving the scene of accident causing death, according to ABC news.

The charge was announced by Chicago police officials on Wednesday. Fox News is reporting that the hit and run driver had previously been cited for driving without insurance, failure to reduce speed to avoid an accident and failure to give information.

The pedestrian victim was crossing the intersection in the Humboldt Park neighborhood just after 8 PM when he was fatally hit. Police later located the defendant and the vehicle and the 4700 block of W. Washington Blvd.

An autopsy determined the victim died from multiple injuries in the collision. The death was ruled an accident.

The hit-and-run driver was scheduled to appear in bond court on Thursday.

It has not been reported if a pedestrian accident attorney is involved in the case or if a civil lawsuit has been filed.

Read the story in the Chicago Tribune here.
