Police Searching for Hit-and-Run Motorist in El Cajon

A truck driver was injured in a two-vehicle crash that took place on January 9, around 3 a.m. in El Cajon. According to California Highway Patrol (CHP) officers, a white colored Honda Civic and a truck plowed into each other on an Interstate 8 onramp, east of Mollison Ave.

The crash impact caused the truck to roll over on its side. The roof of the Honda Civic was slashed open and the windshield was crushed. The Honda Civic driver fled from the rollover accident site after the crash.

Emergency crew responded to the crash and immediately took the truck driver to a local hospital for immediate medical attention.

A search was conducted by emergency crews both on foot and by air to locate the Honda Civic driver. We sincerely hope that the Honda motorist is apprehended as soon as possible and brought to justice.

There are several reasons why a driver might choose to flee the accident site, including having no or suspended driver’s license, no insurance, distracted driving, and being under the influence of drugs or alcohol. A complete investigation in this case is needed to determine the at-fault party.

It was revealed by national government statistics that more than 11% of car accidents are hit-and-run crashes. According to the California Highway Patrol (CHP), around 15,600 hit-and-run collisions were reported in the year 2009. In these, around 15,400 people were injured and more than 100 died.

1 Dead, 4 Injured When Drunk Driver Crashes Into Chicago Police Car

A tragic accident occurred late Friday night in the South Austin neighborhood of Chicago, leaving one young man dead, and four others were injured.


According to a police spokesperson, the accident happened at around 11:20 p.m. in the 5200 block of West Harrison Street. Reportedly, a car carrying three passengers struck a squad car near the intersection of West Harrison Street and South Laramie Avenue.


One witness's account stated that, “That [car] had to be traveling at least 80. “He had a red light. He came across the red light. He hit the police vehicle, and after that he spun and hit the parked vehicle, and continued to hit a couple more people before he hit the pole.”


According to reports, a passenger was ejected from the car and hit a pole, killing him. The Cook County Medical Examiner's Office pronounced the 18 year old dead just before 3 a.m.


The two officers involved in the crash did not sustain serious injuries, and were transported to Stroger Hospital. The two remaining individuals involved in the crash were brought to Mt. Sinai Hospital in critical condition.


Later reports of the accident stated that the driver was intoxicated when he drove head on into the police car, and then hit a light pole. The driver has since been charged with reckless homicide, aggravated DUI involving death and aggravated DUI involving bodily harm. Police stated that he was also cited for driving while his license was suspended and not having insurance.


DUI fatality statistics are startling. According to the Illinois Secretary of State, the average DUI offender is:
male (80 percent arrested are men);
34 years old (61 percent are under age 35);
arrested between 11 p.m. and 4 a.m. on a weekend; and
are caught driving with a BAC of .16, approximately twice the illegal limit

According to the National Highway Traffic Safety Administration, an estimated one in every seven, or 14.28% of nighttime weekend drivers are under the influence of alcohol or drugs. Additionally, someone dies every 51 minutes in America as a result of the thoughtless and senseless act of someone climbing behind the wheel after having too much to drink.

Off Duty Police Officer Kills 2 College Students in Chicago DUI Wrong Way Crash

Last month, two college students were killed tragically when their car collided head on with a vehicle traveling in the wrong direction. The two young men were traveling southbound on Lake Shore Drive at around 4 in the morning on March 15 when an off duty police officer's Chevy Trailblazer slammed into their black Jeep. The officer, Terrell Garrett, was allegedly severely intoxicated, which could explain why he was driving on the wrong side of the road at the time of the collision.


According to statements made by prosecutors at the March 18 hearing, Garrett allegedly had a blood alcohol content of 0.184 at the time he was apprehended, which is more than double the legal limit. He was reportedly celebrating his birthday the day when the accident occurred. He faces two felony counts of reckless homicide and two felony counts of aggravated driving under the influence, the judge set his bail at $500,000.


The North Chicago Police Department released a statement that they, “immediately relieved Officer Terrell Garrett of his police powers and has placed him on administrative leave pending the outcome of the Chicago Police Department’s investigation.”


According to state records, approximately 50,000 drivers are taken into custody for driving under the influence of either alcohol or drugs in Illinois annually. Nearly 80 percent of these drivers are first-time DUI offenders. Kansas City Police Officers Injured in Collision with Tree During Pursuit

Civilians aren’t the only ones at risk of a serious injury auto accident.  We look to an accident involving our own Kansas City Police Department, in which two Kansas City Police Officers were hospitalized with injuries when they were involved in a collision with a tree near the 3000 block of 21st street and Walrond Avenue in Kansas City, Missouri.

The patrol cars were responding to a call to assist other officers with pursuit that would eventually become a foot chase.  One police car lost control and hit a tree, seriously injuring a female officer.  She needed to be extricated from the patrol car and was hospitalized.  Her injuries are serious but non life-threatening.

Michigan bike accident lawyer on anti-bicyclist bias by police

I was sent an interesting article that appeared in the New York Times last week titled, “A new breed of lawyers focuses on bicyclists’ rights.” The article focuses on a select few bicycle accident lawyers who are fighting back against the perceived police prejudice against cyclists.

The article dealt more with lawyers taking on tickets and citations against bicycle riders. But as a lawyer who has handled many Michigan bicycle accident cases involving serious injuries after bike riders were hit by cars, I can say I’ve seen this same bias in police in investigations.

Lawyers who handle cases for injured bicyclists need to be aware of two things that resonate from this article:

1. Police reports are often wrong and often erroneously blame the bicyclist. This stems in large part from the misunderstanding many police officers have about cyclist rights when investigating a bicycle accident.

2. In bike accident cases, there’s always a strong predisposition to blame the bicyclist.  Any injury lawyer that thinks otherwise should spend an afternoon focus grouping these cases as I have done, and hearing some of the things that  potential jurors say. Many of our jurors as motorists, feel that cyclists are “in the way” of traffic,” and should be able to avoid cars on the road.  Even when the car hits the biker, jurors tend to find fault with the cyclist just for being on a bike.

These are dangerous cases for lawyers who are inexperienced in handling bicycle accident injury cases. I’ve seen attorneys who aren’t familiar with bike accident liability arguments  get “no caused” on liability, even when they assumed negligence was very clear. Even when it’s undisputed that the car hits the bike, lawyers should never take negligence for granted in these cases.

Although the New York Times article spent a lot of time on police issuing tickets to cyclists for not keeping right, cyclists are also getting tickets for moving out of the designated bike lanes - even when they need to avoid obstacles such as cars or branches.

The bike accident cases I’ve worked on don’t really apply to tickets.  My cases involve injury  car-bicycle collisions, where I believe some police, and many people, tend to blame the cyclists.  The point to all this of course is that while cyclists have the same rights as everyone else on the road, many people harbor an unfounded bias against cyclists because these motorists, police officers, and others aren’t cyclists. And everyone has heard horror stories about how dangerous cycling on roads is, or knows someone who was seriously injured – even when it wasn’t their fault.

A lawyer representing an injured cyclist will have to voir dire extensively to make sure there is no predisposition to side with the motorist to the detriment of his or her injured cyclist client.

It’s nice to think about a Michigan one day, where most of the population cycles. But our current infrastructure makes that a pipe dream at the moment, and there are almost no bike lanes to allow people to safely bike to work.  While it’s nice to think about such a world, I wouldn’t recommend it in cities such as Detroit or Sterling Heights.

My advice to any bicycle rider who has been injured is to talk with an experienced Michigan bicycle accident lawyer who is familiar with and can work to undo the harmful effects of bias against bikers injured in accidents with cars.

Only through careful investigation of the accident scene, interviews with witnesses, accident reconstruction, deposition of the investigating police officers, extensive voir dire, focus groups and juror questionnaires on anti-bicyclist attitudes, can cyclists who were injured through no fault of their own recover their full measure of compensation after a serious bike accident.  In the meantime, keep safe!

Chicago driver hits police car after running red light

A Chicago car crash has resulted in injuries to a police sergeant and two others, according to the Chicago Tribune. The collision occurred when a motorist ran a red light, striking a police car that was then knocked into another car.

The crash occurred on the South Side just after 9:40 PM on Tuesday at Stony Island and 83rd Street. The at fault driver was traveling in a 2006 Audi southbound on Stony Island when she failed to stop at a stop light and struck a marked Chicago police car that was moving westbound 83rd St. The squad car was then knocked into a 1992 Mercedes.

The driver of the Audi, a 32-year-old woman, was taken by ambulance to Jackson Park Hospital. The sergeant was taken to Advocate Trinity Hospital and later released. The Mercedes driver was taken to South Shore Hospital. The exact injuries of each motorist were not reported.

The Audi driver was ticketed for driving to fast for conditions and driving without insurance. The Mercedes driver was ticketed for operating a vehicle with a suspended or revoked license.

Motorist Cited for Texting and Driving after Rear-End Collision with Police Car in Kansas

In our experience as Kansas City Accident Injury Attorneys, we know first hand that texting and driving is a growing concern for not only police trying to help cut down on injury accidents but for other motorists on the road as well who have to wonder if a texting driver is going to be a danger to them.  How many times have you tried to pass a motorist who was all over the road, weaving in and out of lanes, only to see they are face buried in their cell phone sending and reading text messages.  It can be scary knowing someone is being so cavalier about safety.

Last week in Wichita, Kansas, a 47 year-old man in a sports utility vehicle rear-ended a police car that was pulled over, assisting another motorists with a flat tire.  The rear-end collision sent the police car nearly 100 feet down the road and according to eye witness reports happened because the SUV driver was texting and driving.  Thankfully no one was injured in the rear-end collision.

Police Believe Marijuana May Have Been Factor in Fatal Crossover Crash on Kansas Highway 10

There are many factors that can cause a fatal crossover accident on the highway.  Among them is of course distracted driving– but some of the most dangerous factors are alcohol and prescription or illegal drugs.  At Roswold Law Group, we have discussed in great length the dangers of drunk driving, but marijuana can be just as dangerous.  It may not get as much attention as driving under the influence of alcohol, but marijuana use can lull a driver into a zone and cause them to lose focus on the road.

Members of the Kansas Highway Patrol are investigating a fatal crossover crash that happened on Kansas Highway 10 on Saturday.  Two people were killed in the fatal accident including a five year-old child.  The KHP says a 24 year-old man driving a Toyota Camry crossed over the median and hit a Dodge van carrying four passengers, all of whom suffered serious injuries and were hospitalized.  The crash killed the driver of the Toyota and a five yr-old in the van.  Two adults and a 23 month-old child were taken to the hospital.

A preliminary autopsy has revealed the 24 year-old driver tested positive for marijuana use and it has yet to be determined if it was a factor in the crash.  The victim was the only one involved in the crash who was not wearing his seat belts.

Police Cruiser Hits Woman in Wheel Chair; Kansas City Pedestrian Safety a Concern

There are many reasons serious auto injury accidents happen, but distracted driving continues to be one of the most common causes of serious injury accidents.  If motorists aren’t paying attention, it becomes hard to spot the little obstacles that can cause accidents such as pedestrians and bicyclists.  The important thing to remember is that anyone can be guilty of distracted driving and if driving is part of your job– whether you are a delivery driver– or, as in this case, a police officer– paying attention is absolutely crucial as you can often be distracted maybe a little more easily.

Take this case that happened in Dayton, Ohio.  A 50 year-old woman in a wheelchair was struck by a vehicle while crossing a street.  Pedestrian accidents are not uncommon but what makes this pedestrian injury accident different was that the woman was hit by a police cruiser.  According to reports from the scene, the officer was responding to a non-emergency near by.  He was traveling at a normal rate of speed but did not have his sirens or lights on.  The woman suffered serious injuries that have been down graded to non-life threatening injuries.  The officer involved in the crash was shake up but is okay.

The real tragedy here is that accidents like this one can be avoided.  Distracted Driving is very dangerous and many people don’t realize how distracted they can get while driving.  Anything you do that takes your eyes off the road is an example of dangerous driving.  This includes cell phone talking and texting and even casual conversation with passengers.

A police officer was killed after he lost control of his patrol car and hit an electrical pole. The officer was responding to a two-car traffic accident at the time, reports a NYC Car Accident Lawyer. The officer was a well-respected member of the Jemison police department. Police investigating bus accident in which 14 people were killed, 18 injured

There was a horrific bus accident in New York over the weekend in which 14 passengers were killed and another 18 passengers injured. Every one of the 32 passengers on the bus were either killed or injured in the bus accident in which the bus was cut in half.

The bus driver, Ophadel E. Williams, 41, of Brooklyn told police that he was involved in a hit-and-run accident with a semi-truck before the accident.

Witnesses, however, report that the bus driver was speeding at the time of the accident and no one has confirmed a hit-and-run incident.

The National Transportation Safety Board along with local police authorities will investigate the accident before a determination of cause is made.

While commercial truck accidents have been decreasing in recent years, the number of bus accidents rose between 2004 form 9,182 in 2004 to 14,292 in 2008 according to the Federal Motor Carrier Safety Administration.

According to The New York Daily News, Williams was driving for World Wide Travel which has had five safety violations between December 2009 and October 2010. If it is determined that Williams was speeding at the time of the accident, he could face criminal charges.
