A man on his cell phone rear-ended a vehicle and fled the scene when police approached him late Sunday morning in Chicago. As he fled, he caused a second collision just two blocks away, seriously injuring himself and up to five others in the Park Manor neighborhood.

A police officer who was filling his gas tank near Indiana Avenue and Marquette Road and saw a car driven by a man rear-end another vehicle. It is believed the driver was on his cell phone at the time of the impact. Both cars pulled over after the impact and the officer responded, initially talking to the car that was struck. When the officer began to walk to the at-fault vehicle that caused the rear-end crash, the driver took off from the scene. He tried to drive west on 71st Street over the Dan Ryan Expressway but he hit a minivan that was trying to turn left onto State Street.

The first crash resulted in damage only to the front vehicle which had a man and woman inside at the time of impact. They witnessed the second crash and said that an individual from the minivan was ejected as a result of the collision.

Police have said that the at-fault driver was in serious-to-critical condition after the accident and that four people inside the van were also hurt. Three people were taken from the scene to Advocate Christ Medical Center in serious-to-critical condition and three others were taken to Saint Bernard Hospital and Healthcare Center where their conditions were not immediately known.

The Chicago Police Department has not yet stated whether the driver who caused both collisions will face any civil or criminal charges.

Assuming this early information is all correct, the at-fault driver in these accidents committed several negligent acts. Initially he drove while on his cell phone. Cell phones are a significant distraction to drivers and are responsible for many crashes. In addition, using a cell phone without a hands-free device is a violation of local laws in many areas, though it is unclear how this driver was using his phone at the time of the first crash. In addition to driving while distracted, this driver fled the scene of a collision without speaking to police or providing identification information. What was only a minor collision with a small amount of property damage instead became a crime when the driver fled the scene and seriously injured several others. Finally it appears that the driver failed to yield the right-of-way to the minivan and thus caused the second collision. Though not all the details are yet known, collisions that eject one or more passengers often have a significant force, meaning that the car or the van or both could have been traveling at a fast speed.

A serious collision occurred when a northbound Honda drove in the southbound lanes last week on the Chicago Skyway, according to police. The Honda struck a southbound pickup truck near 84th Street and caused a violent impact that pushed the pickup truck into a concrete barrier.

The driver of the pickup truck was injured and was treated at South Shore Hospital and later discharged. In addition to the driver, two passengers were in the Honda and all were injured and treated at various hospitals with the driver reportedly suffering a broken arm. A female passenger has been described as "gravely injured" and it is not clear whether she will survive.

It is not yet clear what caused the Honda driver to travel in the wrong direction but police say the driver will be issued citations.

Though it is not clear if alcohol was involved, alcohol is a common factor in many of the wrong-way collisions that occur in the United States every year. A driver under the influence is less aware of other motorists, including the direction they are traveling, and statistically pay less attention to road signs, making it easier to drive against traffic without realizing it.

A fatal crash between a drunk driver and a motorcyclist last June has resulted in a 10 year prison sentence for the driver. The incident occurred last June in Naperville, Illinois and claimed the life of an innocent motorcyclist.

Not only was the at-fault driver under the influence of marijuana, he was also engaged in a road-rage incident that further caused him to driver recklessly and irresponsibly, making him a danger to himself and everyone on the road. The driver reportedly got into an argument with three teenagers in another car while stopped at a traffic light. He then attempted to chase down the teenagers and drove aggressively while doing so. As he was chasing the teens, the driver failed to exercise caution and collided with and killed a motorcyclist, who was a resident of Lombard and who died at the scene due to the severity of his injuries.

After the collision, the driver fled the scene but was later found by police officers who charged the man with aggravated driving under the influence and leaving the scene of an accident. The driver was found guilty of both charges in March and was just sentenced this week. In addition, he was also charged with aggravated reckless driving and misdemeanor charges of possession of marijuana, obstructing an officer, and failing to yield while turning left.

This crash was preventable and did not need to happen. Unfortunately the driver in this case got behind the wheel when he was unfit to do so and he should never have been driving that day. In addition to driving under the influence, the man engaged in a situation with another vehicle that led to road-rage and a fatal collision with an innocent biker. Van Driver in Illinois Crash that Killed 5 Had Suspended License

The driver of a van that was involved in a bad rollover crash last week in southern Illinois was driving on a suspended license, according to the Associated Press.

Though the Illinois State Police Department has not identified the driver, the Associated Press obtained the citation issued as a result of the crash which did list the driver's name. From there, it could determine the driver, a resident of New Jersey, had his license suspended last year for insurance-related issues after failing to make three mandatory payments to a New Jersey court. His license was also suspended briefly in 2002 for falling behind on child support.

The crash occurred in Vandalia, Illinois on I-70. Some reports indicate that the van was on the highway while others have stated that the van was on a highway ramp but it is clear that the driver lost control of the vehicle which flipped and rolled over several times. Eleven people were in the van at the time and nine of them were ejected as the van rolled. Five of the passengers died.

The van was reportedly traveling from California back to New Jersey after a week-long ministry gathering out west when the Illinois crash occurred. The names of all the victims have not yet been released but it has been learned that the driver as well as at least one of the passengers had criminal pasts, including incarceration, for crimes unrelated to this incident.

The victims are believed to have been members of Victory Outreach International, a religious group that attempts to help people take control of their lives as well as reaching out to at-risk groups. With over 700 churches world-wide, Victory Outreach is also known for providing drug and alcohol rehabilitation services to those in need.

Though the driver in this accident was cited for improper lane usage and driving on a suspended license, it is possible that he could be charged with additional traffic and possibly criminal offenses once the cause of the crash is determined.

In addition to any citations issued by the Illinois State Police Department, the driver of the van may face civil claims or lawsuits by the passengers that were injured or by the families of those who were killed. A crash early Wednesday morning on the Eisenhower Expressway was not merely an accident, according to local police. The driver of the vehicle was legally drunk and under the influence of alcohol when she crashed her car in Elk Grove Village in the early morning hours, backing up traffic and causing delays for several hours.

It now appears that the woman was driving a minivan northbound on I-290 near Biesterfield Road when she lost control. The van veered across all lanes of traffic before striking a poll and coming to a stop where the car caught fire. The fire spread rapidly and engulfed the entire vehicle within minutes in a hot and intense burn.

Another driver saw the crash and stopped to help because he believed it to be the appropriate thing to do. Ironically, this Good Samaritan had just seen the movie Fast & Furious 6, a theatrical release known for its car racing, crashes, and action stunts. As the Good Samaritan approached the car, he noticed the driver was still inside and that she was obviously injured. Her face was cut and bleeding and she seemed to be searching for something within her vehicle. After confirming that there were no other people inside the minivan, the Good Samaritan told the female driver that her vehicle was on fire and that she needed to get out, immediately, because he feared the fire spreading or the vehicle exploding.

The injured driver exited her vehicle and emergency reponders provided her with transportation to a local hospital where she was treated for her injuries. Authorities stayed at the scene to put out the fire and investigate the crash, including why it occurred, and in combination with other information, they came to the conclusion that the woman was under the influence of alcohol at the time of the crash. She was arrested and cited with driving a vehicle under the influence of alcohol, a crime in the state of Illinois.

According to various accounts, which include a journalist as an eyewitness, an accident that occurred earlier this month caused quite a disruption in the Woodlawn, South Side area of Chicago.

Several people, including children and adults, were injured when their vehicles collided outside of a fire station on the 1400 block of East 67th Street. Witnesses reported that the sound of metal crashing could be heard from at least a mile away. According to one witness, a white van failed to stop at a stop sign, and hit a sedan, causing another van to crash into the white van. A nearby shopkeeper who had witnessed the scene expressed her concern that the sedan would have been headed for her business if it hadn't been able to correct its trajectory.

Seven individuals were sent to local hospitals for treatment. Three adults were in fair to serious condition, while four children were determined to be in good condition.

Based on what has been reported so far, this is at least the second accident in recent weeks that was caused by a driver failing to stop at a stop sign.

According to the Insurance Institute for Highway Safety (IIHS), a study of five busy intersections over a period of several months found that, on average, a driver ran a red light every 20 minutes at each intersection. Furthermore, during peak travel times, red light running was even more frequent. An analysis of red light violation data from 19 intersections in four states found that 1,775 violations occurred over 554 hours, which resulted in an overall violation rate of 3.2 per hour, per intersection. While stoplight running is somewhat different than running a stop sign, logically the failure to yield to the traffic signals, as well as the potential for causing devastating car accidents, is the same.

Another IIHS study, this time regarding urban crashes, found that those involving drivers who ran red lights, stop signs and other traffic controls were actually the most common reason for this type of crash in 22% of cases. Regarding car accidents where drivers disobeyed traffic controls, such as the one in this report, injuries resulted 39% of the time.

The driver who initially failed to stop is most likely liable for all of the damages that his action cost. This includes the damage to the two other vehicles reported in the crash, as well as the medical expenses of the seven individuals that were injured. Furthermore, even the passengers in the car of the driver who ran the stop sign may have potential claims against the driver for putting them into harms way, and any potential injuries they may have suffered. School Bus Driver Faces No Charges in Fatal Illinois Crash

A school bus driver involved in a fatal collision near Wadsworth earlier this month will not face any charges, according to the Lake County State's Attorney's Office. At least one witness at the scene of the crash originally indicated the bus driver ran a red light, but officials say that witnesses gave conflicting statements thereafter regarding the cause of the collision.

On April 5, the school bus collided with two SUVs at the intersection of Highway 173 and Kilbourne Road, resulting in the death of one of the SUV drivers. A toxicology report on the victim showed what is believed to be prescription drugs in the SUV driver's system at the time of the crash, adding speculation as to the cause of the collision.

There were 35 children on board the bus that morning which was traveling to Newport Elementary School in Wadsworth. The collision demolished one of the SUVs, caused significant damage to the other, and caused the school bus to roll on its side. In all, 37 people were injured.

In most collisions, people who are injured by the negligence of another driver have a right to bring a claim against at-fault driver's insurance. Taxi Cab Driver Killed, Passenger Injured in Mission Valley Accident

A 36-year-old taxi cab driver, not wearing a seat belt, was killed in a single vehicle crash that took place on December 15 around 6:04 a.m. at northbound state Route 163. According to California Highway Patrol Officers, the cab driver was speeding on the rain soaked curve when he lost control of the vehicle.

The cab went off the right side of the pathway and struck a concrete wall on its passenger side. The motorist suffered a vehicle ejection, suffered a fatal head injury, and was pronounced dead. We send our condolences to the deceased victim’s family members for such a devastating loss.

Motorist Fatally Struck by Suspected Drunken Driver in Lakeside

A 42-year-old motorist was struck and killed in a driving under the influence (DUI) crash that took place on January 20 around 4:10 a.m. in Lakeside. As stated by California Highway Patrol, the victim was hit by a 38-year-old driver. The deceased victim was driving his Chevy Astro minivan, towing his wife’s Toyota Tercel when one of the vehicles experienced a mechanical issue.

The deceased victim got out of his car and was walking back to his wife to talk to her through her the driver’s window when a vehicle drifted along the right shoulder of the road and fatally hit him. The victim’s wife and the alleged drunk driver escaped unhurt in this fatal DUI crash.

California Highway Patrol Officer Brian Pennings said that the man was booked into the San Diego Central Jail for felony vehicular manslaughter and drunken driving.

Driver Distracted By Cell Phone Charging Cord Causes Fatal Accident

Authorities believe that a driver was distracted by a cell phone charger cord that was tangled around his steering wheel when he caused an accident on August 8, 2013.


The accident occurred in the 13900 block of South Cicero Avenue earlier this month. The at-fault driver reportedly was driving a Ford Taurus when he became distracted by his cell phone charger around 4:45 p.m. The Taurus turned into the rear passenger door of an SUV and caused a crash, leaving the family within the SUV injured. The occupants included a husband, wife, and their son. Both the husband and son survived with minor injuries and received treatment at Palos Community Hospital. The wife was initially transported to MetroSouth Medical Center in Blue Island but later was transferred to John H. Stroger Hospital of Cook County for further treatment. According to her family, she survived for several days before succumbing to her injuries. Her family also indicated that the woman had a history of heart problems before the accident that may have been aggravated by the crash.


Police investigating the accident cited the driver of the Taurus for failing to reduce his speed to avoid an accident, improper lane usage, and driving without insurance on his car. It is unclear whether the driver will face any additional charges stemming from the death of the woman in the other vehicle.

Driver Runs Stop Sign, Injures 4 Before Fleeing the Scene

Early Saturday morning, a taxi cab driver and three passengers were injured when they became unwilling victims in a Chicago hit-and-run accident. The crash occurred at the intersection of Congress Parkway and Ogden Avenue at just after 2:00 a.m. and witnesses say a Ford pickup truck was to blame.

The truck was reportedly traveling east on Congress Avenue in the early morning hours as it approached Ogden Avenue. There is a stop sign controlling eastbound traffic but the truck allegedly failed to stop and entered the intersection, striking the rear passenger door of the taxi. After the collision, the driver of the truck fled the scene without stopping to check on the other car or without speaking to police, who responded to the crash. Ambulance crews transported the passengers of the taxi and the driver to area hospitals for treatment will all expected to survive.

Police officers are looking for the driver of the Ford pickup truck that caused the crash as part of their investigation.

If the facts stated so far prove to be true, the driver of the truck in this accident was a danger to himself and others. Not only did he fail to stop at a stop sign but he also fled the scene of an accident without checking on those in the other car. Both of these are serious crimes in Illinois and can carry a jail sentence, depending on all the factors involved, if a driver gets convicted.

No one knows why the driver in this accident fled the scene after causing a crash, and that is the case in most hit-and-run accidents. DUI Driver Who Fled Scene of Fatal Crash Gets 7 Year Prison Sentence

An Aurora man will serve seven years behind bars for striking two and killing one with his van back in 2010. The 33-year-old man was charged with driving under the influence of alcohol and leaving the scene of an accident that resulted in serious bodily injury or death, to which he pleaded guilty in February of this year.


The prosecution stated that the defendant had been drinking on October 25, 2010 and later chose to get behind the wheel and drive. The defendant approached Grant Street in North Aurora where a man and woman were walking around 2:00 a.m. The defendant struck both pedestrians with his van and fled the scene without speaking with police or even checking to see if his victims were alive.


The female victim, a 22-year-old Cicero resident, died as a result of the accident. She had been walking with her boyfriend, now 25 years old, when both were hit. The man survived the crash with serious injuries, including injuries to his shoulder, knee, and head with a knee replacement needed at some future point.


The defendant driver of the van turned himself in to authorities as an Aurora police station approximately two hours after the incident. His blood alcohol content was measured so that the level at the time of the crash could be determined. Based upon the results, prosecutors contended that the defendant had a BAC between .10 and 0.18, higher than the legal limit of .08. Armed with this information, the defendant was charged with driving under the influence and leaving the scene of a crash.


The presiding judge sentenced the defendant to seven years, four of which were for the charge of leaving the scene of an accident that resulted in death, and the other three for aggravated driving under the influence of alcohol. The sentences are concurrent, meaning that the defendant will have to serve one and then the other back-to-back, totaling a seven year prison sentence behind bars.


This accident illustrates how quickly one or more bad decisions can turn deadly. A car may be a means of transportation but when in the wrong hands, it can also be a weapon. Here, a driver admitted that he had been drinking and that he chose to drive anyway. Even if he had not caused an accident, he would have committed a crime simply by operating a motor vehicle under the influence of alcohol. Not only did this man drive drunk, but he also struck two pedestrians, killing one and seriously injuring the other.


Illinois makes it a crime to leave the scene of an accident and it is a felony if that accident results in death or serious bodily injury. The rationale behind this law is that if a motorist stops and stays at the scene, the motorist may be able to call for help, increasing the chance of a victim surviving or limiting the extent of injuries suffered. When a driver fails to remain at the scene, that driver can face serious time behind bars, like the defendant in this accident now faces.

School Bus Driver Arrested in West Chicago Suspected of Driving Drunk

A 42-year-old South Elgin woman was arrested Friday for suspicion of driving under the influence of alcohol. What made this incident particularly distressing to many parents was that the woman was a school bus driver and was driving her assigned route at the time she was arrested.

It is unclear at this time whether any children were on the bus but authorities have stated that the woman was pulled over after a school employee reported that the employee smelled alcohol on the school bus driver's breath. The driver was pulled over in West Chicago where police officers performed a field sobriety test, leading to her removal from the bus and arrest by the officers.

At this time, the school bus driver has been charged with aggravated driving under the influence of alcohol and bond has been set at $100,000. If the woman is convicted, she could face up to three years incarcerated in prison as well as being labeled a convicted felon.

Driving under the influence of alcohol and/or drugs is very dangerous and puts the lives of all other drivers at risk. For this reason, Illinois makes it illegal to drive a motorized vehicle under the influence of alcohol and it presumes that drivers are drunk when their blood alcohol levels are 0.08 or higher. However, merely having a BAC below 0.08 does not mean that a motorist is not under the influence; in fact, any driver who is affected by alcohol can be cited for driving intoxicated, regardless of what his or her BAC is at the time of arrest.

School bus drivers are held to a different, and higher, standard than average drivers on Illinois roads. There is no leniency when it comes to school bus drivers and alcohol. Illinois law forbids any school bus driver to operate a bus while there is any alcohol in his or her system, and a violation of this prohibition is breaking the law. The rules are much stricter when it comes to school bus operators because of the nature of their jobs and those who ride as passengers. A fully loaded school bus can easily carry in excess of 50 students, all of whom place their safety and security in the hands of the driver. With so many people on board, it would be easy for an accident to turn catastrophic in a moment. Decreasing the risks faced by these children decrease the odds of a school bus accident and increase the chances that all children will remain safe while traveling to and from school.

Unlicensed Driver Sentenced to 4 Years for Reckless Homicide

A driver has been sentenced to four years in prison for his role in an accident that claimed the life of a 44-year-old Chicago man. The driver, who has already spent about nine months behind bars, could be released after as little as two years, leaving some in the community upset that the sentence is too light.

Authorities say the driver was speeding as he drove eastbound on Devon Avenue last November. The victim, a well-known member of the Tibetan community in Chicago, was crossing the street in West Rogers Park with his brother-in-law as the driver approached. The driver reportedly swerved into the westbound lanes of traffic and struck both men, briefly stopping at the scene to see if the men were hurt. Witnesses say the defendant then fled the scene without calling for help or speaking to police.

The 44-year-old victim died as a result of his injuries and his brother-in-law was injured but survived. The extent of the brother-in-law's injuries are not known but a family friend of the men say that the deceased victim left behind a wife and three young sons. The victim worked for the Cook County clerk's office as well as holding the position of vice president of the Rogers Park Chamber of Commerce board.

Police investigated the accident and eventually identified the driver. The 23-year-old man was arrested and charged with reckless homicide and failure to report an accident. Officials report that the defendant pleaded guilty to both charges and received a four year prison sentence in response. Police have stated that the defendant did not have a valid driver's license at the time of the accident and apparently had never held a valid license previously. It is not clear whether the defendant also faced charges related to driving without a license but his sentence was not based on any related charges.

While the criminal case facing the driver in this accident may be settled, the implications from his actions may not be. In the case of a pedestrian who is killed through the reckless or negligent actions of a driver, Illinois law allows for the possibility of a civil recovery by the victim's surviving family members. Here, the 44-year-old man's surviving family, his wife and children, may be entitled to bring a monetary claim for their losses against the defendant driver who caused the accident. Elderly Driver Crashes Into Liquor Store, Causes Fire

Police have reported that an 84-year-old woman was behind the wheel when her car crashed through a local liquor store on Thursday. The woman reportedly hopped a curb and crashed through the front entrance of Binny's Beverage Depot in Highland Park on Monday where her vehicle entered part of the store and came to rest between several stacks of liquor.

The woman states that she has never had an alcoholic drink in her life and that she believes her accelerator on her 1998 BMW may have stuck, causing her car to continue forward at Crossroads Shopping Center. The driver remained in her car until an employee of the liquor store helped her to safety. The crash also started a fire in the store that officials believe was fueled by the liquor itself.

Both the employee and the driver were taken to area hospitals where they were treated for minor injuries. Both are expected to fully recover and the driver has been released at this time. The current condition of the employee is not known. The store had a sprinkler system that helped keep the fire under control until fire fighters arrived. The blaze was extinguished shortly after fire officials arrived and eyewitnesses noted a large amount of smoke billowing from the building.

There has been no word on whether any customers were in the store at the time of the crash but several other employees were inside. None of them sustained any injuries but witnesses said that employees were covering their mouths as they exited the smoke-filled building. Police are still investigating the cause of the crash and it is not yet known if the driver will be cited for the accident.

Though the driver claimed that her accelerator stuck and caused the accident, that has not yet been confirmed and it is not clear whether the driver's advanced age contributed to the crash. When a driver is negligent and causes an accident, though, the driver may face traffic charges or a civil claim for any injuries that result. The law requires every driver to act with due care and caution while behind the wheel and when a driver fails to do so, the driver breaks the law.

1 Dead, 4 Injured When Drunk Driver Crashes Into Chicago Police Car

A tragic accident occurred late Friday night in the South Austin neighborhood of Chicago, leaving one young man dead, and four others were injured.


According to a police spokesperson, the accident happened at around 11:20 p.m. in the 5200 block of West Harrison Street. Reportedly, a car carrying three passengers struck a squad car near the intersection of West Harrison Street and South Laramie Avenue.


One witness's account stated that, “That [car] had to be traveling at least 80. “He had a red light. He came across the red light. He hit the police vehicle, and after that he spun and hit the parked vehicle, and continued to hit a couple more people before he hit the pole.”


According to reports, a passenger was ejected from the car and hit a pole, killing him. The Cook County Medical Examiner's Office pronounced the 18 year old dead just before 3 a.m.


The two officers involved in the crash did not sustain serious injuries, and were transported to Stroger Hospital. The two remaining individuals involved in the crash were brought to Mt. Sinai Hospital in critical condition.


Later reports of the accident stated that the driver was intoxicated when he drove head on into the police car, and then hit a light pole. The driver has since been charged with reckless homicide, aggravated DUI involving death and aggravated DUI involving bodily harm. Police stated that he was also cited for driving while his license was suspended and not having insurance.


DUI fatality statistics are startling. According to the Illinois Secretary of State, the average DUI offender is:
male (80 percent arrested are men);
34 years old (61 percent are under age 35);
arrested between 11 p.m. and 4 a.m. on a weekend; and
are caught driving with a BAC of .16, approximately twice the illegal limit

According to the National Highway Traffic Safety Administration, an estimated one in every seven, or 14.28% of nighttime weekend drivers are under the influence of alcohol or drugs. Additionally, someone dies every 51 minutes in America as a result of the thoughtless and senseless act of someone climbing behind the wheel after having too much to drink.

Fatal Alpine Traffic Crash Kills Driver

One person was killed in a serious traffic collision that occurred on September 15, 2011, around 1:15 p.m. in the 1300 block of Tavern Road in Alpine. According to California Highway Patrol, one of the vehicles involved in this car crash veered off the roadway and smashed into a fire station.

One person suffered life-threatening injuries and was pronounced dead at the accident scene. Based on the limited information provided in the news accounts, the cause of the accident is not clear. It is under investigation and the results will shed light on who was responsible for the accident.

A drunk driver was arrested on Wednesday August 24 2011 after he crashed his Chevy Blazer into the roof of a house at the intersection of Kensington and 43rd street.  The SUV caused the roof to sink into the first floor.   The driver was a 20-year-old man from the city of Grandview and he has a male and female passenger in the vehicle.  He was speeding through the intersection without a seatbelt when he ran off the road and into the victim’s yard.  His car was launched off the yard and into the roof.   None of the eight occupants of the house were reported injured, but the driver was taken to the hospital for minor injuries.  The house is believed to be beyond repair.

Deadly Chicago area auto accident caused by wrong way driver

Two people have died in an Illinois car crash caused by a man who drove his red Porsche the wrong way down an Illinois tollway. The man had allegedly been arrested for DUI twice in the past, the Chicago Tribune is reporting. Police are still trying to figure out why the man was driving recklessly and why there was U.S. currency flying out of the care before the accident.

According to the Chicago Sun-Times, the collision occurred near Lisle, Illinois on I-88, in between I-355 and Route 53, during the early evening on Saturday. The 43 year-old driver of the Porsche was heading east when he used an emergency vehicle turnaround to enter the westbound lanes, and continued to head east. Soon after, the Porsche collided with a 2004 Toyota Corolla carrying three people, killing two and placing one in critical condition.

Illinois State Police identified the two victims as a 37 year-old woman and her 74 year-old father. A 42 year-old passenger is in critical condition. The family was on their way to a mosque when the crash occurred, and other family members headed to the same destination were close enough to hear the collision and make an attempt to pull the victims from the wreckage.

The Chicago Tribune later reported that witnesses saw money flying out of the Porsche as it was driving down the road. One witness said that when she passed by the driver, she saw the man grab a handful of cash from his passenger seat and throw it out the window. She also saw multiple cars pull off to the shoulder of the road in what she assumed was an effort to pick up the ejected money.

The man’s previous DUI arrests were drug, not alcohol related, the Tribune article stated, although he was convicted in 2010 for transporting open alcohol containers after police found three empty beer cans in his car. The man had been a practicing dentist in Naperville, Illinois, but had quit around a year ago because he said he was losing money. On July 28 of this year, his mortgage company filed foreclosure documents on his Naperville, Illinois home.

No matter how many precautions you may take while driving, there are always factors beyond your control that can cause serious injury or death, such as the wrong way motorist in this accident.

Safe Driver Act of 2011 Could Increase Distracted Driving Laws in Illinois

Illinois is already one of the states in the United States that has banned the use of cell phones by drivers in school and work zones and has banned all drivers from text messaging in an attempt to reduce the frequency of distracted driving car accidents in Illinois, according to the Governors Highway Safety Administration. While many motorists ignore these safe driving laws, they may soon have another force fighting their distracted driving habits. A proposed federal law. Introduced by Rep. Carolyn McCarthy, D-N.Y., aims to federalize driving and cell phone usage. These types of laws are currently managed by individual states-- and sometimes even cities as is the case with Chicago's cell phone ban.

Our Chicago car accident attorneys hope that this proposed legislation will one day serve as additional ammo in the fight against distracted drivers. The proposed bill would direct the U.S. Department of Transportation to set up a standard for the entire country that would prohibit hand-held cell phone use while driving.

“Driving while making a phone call, texting or using apps can be as dangerous as driving drunk, and much more common,” Rep. McCarthy said. “With some basic commonsense rules that are already in place in some parts of the country, we can reduce injuries and save lives in America.”


There are a few exclusions to this proposed law. Drivers would still be allowed to use voice-operated, vehicle-integrated devices, as well as voice-operated GPS systems. Even though there are cognitive distractions still present with hands-free devices, they pose a much less serious problem than using a hand-held device.

Under the proposed bill, the Department of Transportation would be required to conduct a study on distracted driving. This study would be required to focus on the issue of cognitive distraction and the impact of distraction on newly licensed, young drivers. Within two years of the completed study, the DOT would then be required to report its findings to Congress. Recommendations for revising the minimum distracted driving prohibitions and penalties must accompany this report. These newly proposed minimum distracted driving prohibitions would be mandatory for all states. Each state would then be allotted two years to comply with the law or lose a quarter of their federal highway funding.

Currently, each state is able to create their own laws regulating cell phone and texting use. Some states offer strict laws to prevent distracted driving while others have absolutely no restrictions at all. A majority of states ban teenagers from using cell phones while driving. Texting behind the wheel of a motor vehicle is forbidden in some 30 states. If this proposed bill becomes law, the entire country would be put under a seamless law that would require all motorists to follow it or face the consequences.

According to the National Highway Traffic Safety Administration, nearly 5,500 people died because of car accidents that involved a distracted driver in 2009. These accidents accounted for roughly 1 in 6 of all motor-vehicle accident related fatalities that year.
